Who you wish to be your Executors (female Executrix) and Trustees (these can be the same person / s). We advise that the person you choose may have quite an onerous task to administer the Will especially if it is challenged or needs to go to probate. The person you choose should be someone who is your age or younger and someone you believe will be willing and able to undertake the task. You can choose more than one person to undertake this task. You can choose one person to undertake this task and write a clause to the effect that if they pre-decease you, then another one or two (or more) people who you wish to undertake the task. If more than one Executor / trix at any one time please provide an order in which they may make decisions such as by agreement (a decision won’t be made if one disagrees), by majority (if more than two and being an odd number) or by order of preference (please specify who will have the superior decision making ability).

Next to each name, please place their date of birth and address as well as their relationship to you. Please also list any other descriptors that are relevant for each beneficiary.

You can make specific gifts of monies or proceeds of sale of any property in an amount or you can make a percentage (proportional) division to each beneficiary should you wish. You can list that if a person pre-deceases you that their children receive their gift and for it be divided in specific proportions. When you list your beneficiaries, you can make provision for a gift to given to them once they attain a certain age. This involves creating a testamentary trust and is not a simple process. Please advise if this is required and we can take these further instructions from you and advise on additional costs.

Please advise how you would wish your estate to be divided should one or all of the listed beneficiaries pre-decease you (or not survive you for a period of 30 days). If all of your gifts fail due to the ineligibility of the listed beneficiary / s you may wish to gift your estate to a charity or other organisation.
