A will is a legal document that outlines your wishes regarding the distribution of your assets and the care of your dependents after your passing. In Cairns, Australia, writing a will is a fundamental step in estate planning, ensuring that your assets are managed according to your desires. In this blog, we will guide you through the process of writing a will in Cairns, addressing key considerations and steps to follow.

Why Write a Will?

Why Write a Will

Writing a will is essential for several reasons:

  • Asset Distribution: A will allows you to specify how your assets, such as property, savings, and personal belongings, should be distributed among your loved ones.
  • Guardianship: If you have minor children, a will enables you to appoint a guardian who will care for them after your passing.
  • Peace of Mind: A properly executed will provides you with peace of mind, knowing that your wishes will be respected, and your loved ones taken care of.

Key Considerations for Writing a Will in Cairns

You must consider the following when writing a will:

  • Eligibility: In Cairns, you must be at least 18 years old to create a will. You should also be of sound mind and not under duress.
  • Executor: Appoint an executor, the person responsible for administering your estate and ensuring your wishes are carried out. This can be a trusted family member or friend.
  • Assets and Liabilities: Make a list of all your assets and liabilities. This includes property, bank accounts, investments, debts, and personal belongings.
  • Beneficiaries: Clearly specify who will receive your assets. This can include family members, friends, charities, or any other beneficiaries you choose.
  • Guardianship: If you have minor children, name a guardian in your will. Ensure you discuss this with the chosen guardian beforehand.
  • Specific Bequests: If you have specific items you want to leave to particular individuals (e.g., family heirlooms), detail these bequests in your will.
  • Funeral Wishes: You can express your funeral and burial, or cremation wishes in your will, although it is not legally binding.
  • Review and Update: Periodically review and update your will to ensure it reflects your current circumstances and wishes.

Keeping it safe

It is important that you store your will in a safe and easily accessible place, and inform your executor and loved ones of its location so that it can be easily accessed following your death.

Seek Legal Advice

While writing a simple will can be done independently, seeking legal advice is recommended, especially for complex estates. A solicitor can ensure that your will is properly executed, minimising the risk of disputes and legal challenges.

In Cairns, writing a will is a crucial step in estate planning, ensuring your assets are distributed according to your wishes. By following the legal requirements and seeking professional advice when needed, you can create a will that provides security and peace of mind for you and your loved ones.
