When clients come to James Noble Law for guidance on divorce, they’re often surprised by how many deadlines sit quietly behind the process. Divorce in Australia is largely administrative, but it is also highly procedural. Missing a date, filing late, or overlooking a service requirement can derail an otherwise simple application.
If you are applying for divorce in Brisbane, it is essential to understand these timeframes, especially the service deadlines. They don’t just affect your hearing date. They can also affect your broader family law strategy, including your property settlement.
Australian divorce law requires couples to be separated for at least 12 months before filing a divorce application. This is a strict threshold under the Family Law Act 1975 (Cth). If you’ve been separated under one roof, the Court will need extra evidence to confirm the separation. Preparing these affidavits (sworn written statements) takes time, and it’s often where delays first begin.
At James Noble Law, we regularly help clients gather the right evidence early, so the application is ready to file as soon as the 12-month period ends.
Once a sole divorce application is filed, the next critical step is service. “Service” means formally delivering the documents to your spouse. The Court must be satisfied that your spouse has received the documents, and it sets strict minimum timeframes to make sure the process is fair.
If your spouse is in Australia, they must be served at least 28 days before the hearing. If they are overseas, the timeframe extends to 42 days. These deadlines are non-negotiable. If service is late or incomplete, the Court will adjourn (postpone) your hearing. This often pushes your divorce back by weeks or months.
This is one of the most common reasons Brisbane divorce hearings are delayed.
Service is often more complicated than people expect. You cannot serve the documents yourself. Service by post also requires your spouse to sign and return an Acknowledgment of Service. If they don’t, the Court cannot accept that service occurred.
Many clients run into issues such as:
In these situations, you may need to apply for substituted service. This means asking the Court to allow another method, such as email, social media, or delivery through a third party. In some cases you may need to ask the Court to dispense with service altogether. These applications need extra evidence and affidavits, and they almost always extend the timeline.
James Noble Law often helps clients with these applications, making sure the Court has the evidence it needs to accept other methods of service.
Even when service is successful, the Court needs formal proof. This is usually an Affidavit of Service or a signed Acknowledgment of Service. If these documents are incomplete or incorrect, the Court will not go ahead with the hearing.
This is another area where professional guidance can prevent unnecessary delays.
The timing of your divorce hearing has flow-on effects. A Divorce Order takes effect one month and one day after it is made. From that date, a new deadline begins: you have 12 months to start property settlement or spousal maintenance proceedings.
If your divorce is delayed because service was late or incomplete, the date your Divorce Order takes effect moves too, and so does the 12-month window that follows it. If you miss the deadline a year after the Divorce Order, you must ask the Court for permission to file out of time. Permission is not guaranteed.
This is why James Noble Law focuses on early planning and a proactive approach to service. Getting the divorce timeline right protects your broader family law interests.
The best way to avoid service problems is to plan ahead.
