Without a Will in place, your estate will be dealt with under the rules of intestacy (ie. under the Laws of Intestacy) which differ from state to state and may not be what you want to happen with your estate. It is also important to have a will because of the potential tax benefits that could be available in relation to your estate.

Yes, an executor can change a will. This is done by filing a petition with the court. The court will then appoint a new executor who will have the power to change the will. nHowever, it is a good idea to get a lawyer involved to help deal with the paperwork involved in this process. An executor is a person who is responsible for managing the estate of the deceased person and carrying out the instructions in the will. nIn some cases, the person appointed to manage the estate may not be able to fulfill this role due to illness or other reasons. In this case, the court can appoint a new executor to handle the estate. This depends on the circumstances and how the deceased's wishes were carried out in the first place.

When a person dies, the estate is divided among his heirs. This is usually done through a will, but if there is no will, the law determines who gets what. This law, known as intestate succession, varies from state to state. In all states, a spouse is entitled to the first $60,000 of the estate; children share the rest of the estate equally if they are under age 18; and adult children get nothing if they are not living with their parents. If there is no spouse or children, an estate passes to the decedent's parents, brothers, and sisters. If the deceased has no parents, brothers, or sisters, it passes to the decedent's siblings. If there are no surviving siblings, the estate goes to a surviving spouse, children, or grandchildren of the decedent.
